Is the Samsung Galaxy Tab is an imitation of the iPad? A German court afraid so, and therefore forbidden to sell it in Europe
Is Samsung copied the design of Apple's iPad Galaxy Tab 10.1 - its new Tablet PC? A German court thinks that this argument enough weight to ban the sale of the tab across the EU, ex gratia, while discussions on the subject goes on. The only country where the sale is permitted today is the Netherlands, because there a separate lawsuit against Apple Samsung. It is worth recalling that the Galaxy Tab 10.1 was launched in Britain last week, Samsung is now required to remove it from the shelves. According to Apple, not only for designing the Galaxy Tab 10.1 mimics the design of the iPad, but all the whole device is an attempt of unfair competition in the form of imitation. Please note that this is not an accusation that Samsung violates patents - such a claim should be brought before a court of any European country apart. Industrial design rights, however, may be approved by an agency of the entire Union. This last step in the war between Apple Samsung, waged battles all over the world. Thus, the two companies have sought to ban the imports of other products in the United States International Trade Council of the United States, claiming the company violated patents second.
